A Legislative Act Contrary To The Constitution Is Not Law.

When They Are Said To Exercise A Discretion, It Is A Mere Legal Discretion, A Discretion To Be Exercised In Discerning The Course Prescribed By Law; And, When That Is Discerned, It Is The Duty Of The Court To Follow It. Judicial Power Is Never Exericised For The Purpose Of Giving Effect To The Will Of The Judge; Always For The Purpose Of Giving Effect To The Will Of The Legislature; Or, In Other Words, To The Will Of The Law.

The Government Of The United States Has Been Emphatically Termed A Government Of Laws, And Not Of Men. It Will Certainly Cease To Deserve This High Appellation, If The Laws Furnish No Remedy For The Violation Of A Vested Legal Right.

The Most Lively Fancy Aided By The Strongest Description Cannot Equal The Reality Of The Opera.

Let The End Be Legitimate, Let It Be Within The Scope Of The Constitution, And All Means Which Are Appropriate, Which Are Plainly Adapted To That End, Which Are Not Prohibited, But Consist With The Letter And Spirit Of The Constitution, Are Constitutional.
